Terms of Use

§ 1 Scope of Application

These Terms of Use apply to the use of the mobile application “Travel Delta”. By using the app, the user agrees to these terms.

§ 2 Nature of the Service

Travel Delta provides general travel information and is not a booking portal. All information regarding entry requirements, currency rates, emergency numbers, traffic rules, pet travel rules, and other travel data is provided for general orientation purposes only.

§ 3 Rights of Use (License)

Travel Delta grants the user a simple (non-exclusive), non-transferable right to install and use the app on their own devices within the scope of its intended use. A revocation or restriction of this right of use will only occur for good cause, in particular in the event of violations of these Terms of Use (see § 10). Any reproduction, modification, decompilation, reverse engineering, or distribution of the app to third parties is prohibited, unless expressly permitted by law.

§ 4 In-App Purchases and Premium Features

The app offers optional, paid premium features that can be acquired as a one-time in-app purchase via the Apple App Store or Google Play Store. Payment processing is carried out exclusively by the respective store operator; their payment, refund, and terms of use apply. The provisions of the respective platform (Apple or Google) also apply to the exercise of the statutory right of withdrawal for in-app purchases. The price displayed in the respective store prior to the conclusion of the purchase is binding. Requests for refunds or cancellations must be directed straight to Apple or Google; Travel Delta has no influence on such decisions.

In-app purchases require full legal capacity to contract. Minors must obtain the prior consent of their legal guardian before making an in-app purchase.

§ 5 Intellectual Property

All content, texts, graphics, icons, logos, and the software of the app are protected by copyright and are the property of Travel Delta or the respective rights holders. Any use beyond the scope of § 3, in particular commercial exploitation, reproduction, or publication, requires prior written consent.

§ 6 Limitation of Liability

Travel Delta shall be liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations, i.e., obligations whose fulfillment is essential for the proper execution of the contract and on the observance of which the user may regularly rely), liability is limited to the foreseeable, typical contractual damage. Otherwise, liability is excluded.

The information provided in the app has been compiled with the greatest possible care. However, no guarantee is given for its accuracy, completeness, or timeliness. In particular, the following applies:

§ 7 Third-Party Content

The app may link to third-party content or services (e.g., partner offers, external websites). Travel Delta assumes no responsibility for the external content and privacy practices of third parties.

The app content does not replace legal, tax, medical, veterinary, or official travel advice. In the case of legal, health-related or veterinary questions, appropriate professionals must be consulted.

§ 9 Data Protection

Information on the collection, processing, and use of personal data can be found in the separate Privacy Policy, which is accessible within the app and on this website.

§ 10 Termination and Suspension of Use

Travel Delta reserves the right to fully or partially suspend or restrict access to the app in the event of violations of these Terms of Use, in particular in the case of abusive or unlawful use. The user can terminate the use of the app at any time by uninstalling it.

§ 11 Amendments to the Terms of Use

Travel Delta is entitled to amend these Terms of Use with effect for the future, provided that such amendment is necessary to adapt to changed legal or technical circumstances, or does not place the user at a disadvantage beyond a mere adjustment. The user will be informed of material amendments in text form (e.g., via in-app notification or email) at least six weeks before their planned entry into force.

If the user does not object to the amendments within six weeks of receiving the notification, the amended terms shall be deemed accepted. The user will be separately informed of this legal consequence in the notification of the amendment. If the user objects within this period, Travel Delta is entitled to terminate the user relationship with four weeks’ notice; the user may also end use of the app at any time before expiry of this period by uninstalling it.

For premium features already purchased (§ 4), the scope of functionality existing at the time of purchase shall remain unaffected by any amendment to these Terms of Use, unless mandatory statutory provisions provide otherwise.

§ 12 Applicable Law and Dispute Resolution

The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

Travel Delta is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Severability Clause

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision, if available.
